Three of the #Lausitz23 still in custody!

A few days ago activists of Ende Gelände blocked a bucket wheel excavator in one of the Lusatian open cast lignite mines. Three of them are still in custody, though the accusation is only trespassing. Obviously the district court in Cottbus does not care that in the past again and again activists were therefore acquitted in court (since the open pit is not fenced).

Call for the first day:
After more than four months of custody, the trial against Eule will take place on Monday, February 4th.

Charges are assaulting law enforcement officers after §114-1 StGB in concert with attempted dangerous bodily injury after §§ 224-1 Ziffer 2, 22, 23, 52 StGB.

Call for trial support on Jan. 24th, 2019

On January 24, the appeal hearing against an anarchist will take place. The charge is “disruption of public companies”, this is a blockade of the Hambach railway.

We want to prevent the next eviction in court!

Due to increasing police violence, it can be assumed that in case of evictions, people brutally will be mistreated again. This can not be allowed and we are sick of it! Let us protect our homes and our tree houses! The evictions are a pretext to clearcut the Hambi piece by piece prematurely. The deforesting stop is thus not observed.

Report of the trial on 12/12 in Daun

The most important first: The law suit because of dumpster diving, on 12/12 before the Daun district court, was abandoned against 50 social services hours (to be completed at an association or society, chosen by the accused and the defense attorney).

Even before the beginning of the trial, some remarkable things happened. First of all, many people were there early on in order to accompany the trial in solidarity. So first a big thank you to all who were there. In particular, the partly long travel routes and the large age range impressed us very much. At some moment also appeared the police witness, an unsympathetic officer named Rönsch (from Kempten in Bavaria, where the real supermarket is located, which made the criminal complaint). more…

Call for solidary process support on 18.12. in Jülich (attempt 2)

After the district court Jülich the date on Nov.27th canceled quite spontaneously, it starts on Dec. 18th at 11:15 am a second attempt. The allegations continue to be „Widerstand gegen Vollstreckungsbeamte in besonders schwerem Fall“ (§113 Abs. 2 StGB) (resistance against enforcement officers in particularly severe cases), „Nötigung“ (§240 StGB) (coercion) and for one of the two defendants additionally „Sachbeschädigung“ (damage, §303 StGB). Will there still be a deforesting season soon?

On October 5th, 2018, the OVG (Higher Administrative Court) in Münster suspended the clear-cutting in Hambach Forest until the decision of the VG (Administrative Court) of Cologne on the legality of the open pit mining in the main proceedings. It was expected by those involved in the process that this might not happen before the end of 2020. Now the VG Cologne announced on December 3, that they want to decide about it already in the first quarter of 2019. If the VG will give right to RWE, they could thus resume the clear-cutting work again in the autumn of 2019 or even at the end of this winter’s deforesting season, depending on the date of the decision.

Abandonment in the Andrea proceedings: report

On 11/29/2018 the first eviction trial took place before the district court in Kerpen. This is the translation of an article by ABC Rhineland:

For the 15 solidary visitors the morning begins with the (meanwhile already routine) entrance checks to the district court Kerpen and a police force of approximately 30 persons.

According to the indictment, Andrea was in a hammock near a treehouse, which was to be evicted, and moved further into the treetop when the altitude intervention team officers were on the same level. During the eviction Andrea is said to have defended herself with punches, kicks and insults like “wanker” and “pigs”. For the prosecutor from this resulted “assault” and “attempted assault” as accused criminal offenses. more…
