Since I am not present today and I also miss the chance for a last word, I formulate here a few (not sober) thoughts on the tripod process and the orderly detention for “lack of respect.”
During the scandal negotiation from 13.06. I was the only one on the prosecution / defense bench who wore shoes from the beginning. I wonder now, why actually? Why do I wear shoes in bright sunshine? Well, probably two reasons. First, I find hot asphalt in the summer actually not very pleasant. And second, presumably vanity. In the two trial days of the first instance and the previous two of the appeal, we have experienced many absurdities in the process of a blockade of the Hambachbahn 2017 and reported on Twitter live under #TripodProzess. The trial because of the tripod, which was suddenly on the Hambachbahn during the G20 summit in Hamburg, goes into the second round. After the district court Jülich has sentenced the two defendants in the first instance to a fine of 90 or 100 daily sentences, the appeal is now being held before the district court of Aachen. So to make you know what you are getting into, first a few quotes from the official protocol of the first instance:
“The following court order is then issued: It is forbidden to disturb the course of the meeting by calling or throwing objects from the spectator area…”

On 17.05.2019, a lawsuit against an anarchist from the Hambach Forest will begin.
The allegations are: Attempted serious assault in coincidence with assault on law enforcement officers in a particularly serious case and with damage to property as well as resistance to law enforcement officers and property damage.
Property damage is doubly in there, because it is about several cases.

A few days ago activists of Ende Gelände blocked a bucket wheel excavator in one of the Lusatian open cast lignite mines. Three of them are still in custody, though the accusation is only trespassing. Obviously the district court in Cottbus does not care that in the past again and again activists were therefore acquitted in court (since the open pit is not fenced).

Call for the first day:
After more than four months of custody, the trial against Eule will take place on Monday, February 4th.
Charges are assaulting law enforcement officers after §114-1 StGB in concert with attempted dangerous bodily injury after §§ 224-1 Ziffer 2, 22, 23, 52 StGB.

On January 24, the appeal hearing against an anarchist will take place. The charge is “disruption of public companies”, this is a blockade of the Hambach railway.

We want to prevent the next eviction in court!
Due to increasing police violence, it can be assumed that in case of evictions, people brutally will be mistreated again. This can not be allowed and we are sick of it! Let us protect our homes and our tree houses! The evictions are a pretext to clearcut the Hambi piece by piece prematurely. The deforesting stop is thus not observed.

The most important first: The law suit because of dumpster diving, on 12/12 before the Daun district court, was abandoned against 50 social services hours (to be completed at an association or society, chosen by the accused and the defense attorney).
Even before the beginning of the trial, some remarkable things happened. First of all, many people were there early on in order to accompany the trial in solidarity. So first a big thank you to all who were there. In particular, the partly long travel routes and the large age range impressed us very much. After the district court Jülich the date on Nov.27th canceled quite spontaneously, it starts on Dec. 18th at 11:15 am a second attempt. The allegations continue to be „Widerstand gegen Vollstreckungsbeamte in besonders schwerem Fall“ (§113 Abs. 2 StGB) (resistance against enforcement officers in particularly severe cases), „Nötigung“ (§240 StGB) (coercion) and for one of the two defendants additionally „Sachbeschädigung“ (damage, §303 StGB).
